Welcome to Hostably. These Terms and Conditions (“Terms”) govern your use of hostably.com (the “Site”), operated by Hostably (“Hostably,” “we,” “us”). By using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

What Hostably is

Hostably is a directory that connects travelers with independently owned and managed vacation rentals. We are not a property management company, a travel agency, or the owner or operator of the properties listed. Each property is run by its own owner or manager (the “Host”), who sets rates, availability, house rules, and policies, and who is solely responsible for the property, the accuracy of the listing, and your stay.

Inquiries and bookings

Listings may let you check availability, send an inquiry, or request or complete a booking. Depending on the listing, a booking is made either through forms on this Site or on the Host’s own website or booking platform. In every case, the booking agreement is between you and the Host. Hostably is not a party to that agreement and does not guarantee that a booking will be accepted or honored.

• Rates, taxes and fees. Displayed rates and totals are set by Hosts and may exclude taxes, cleaning fees, deposits, or other charges. Confirm the full price before you pay.
• Payments. Payments are collected by the Host or the Host’s payment processor. Hostably does not hold your funds unless a checkout page clearly says otherwise.
• Cancellations and refunds. Cancellation, change, and refund terms are set by each Host and shown in the booking process or rental agreement. Please read them before you book.
• House rules and rental agreement. You agree to follow the Host’s house rules and any rental agreement you accept, including occupancy limits, check-in and check-out times, and damage and security deposit terms.

Your responsibilities

• You must be at least 18 years old to make a booking or inquiry.
• Information you provide must be accurate, current, and complete.
• You will use the Site only for lawful purposes and not to scrape, disrupt, or attempt unauthorized access to it, or to submit false or misleading inquiries.
• You are responsible for the conduct of everyone in your travel party during your stay.

Listing information

Descriptions, photos, amenities, availability, and rates are provided by Hosts. We work to keep the Site accurate but do not verify every detail and cannot guarantee that any listing is complete, current, or error-free. Please confirm important details with the Host before you book.

Host services

Hostably may offer virtual assistant and online administrative support services to property owners and managers. These services are provided under separate agreements and do not make Hostably the operator of any property.

Third-party websites and services

The Site may link to or rely on third-party websites and services, including Host booking sites and tools provided by OwnerRez and payment processors. We do not control and are not responsible for their content, availability, or practices, and your use of them is subject to their own terms.

Intellectual property

The Hostably name, logo, and Site design are owned by Hostably or its licensors. Listing photos and descriptions belong to the Hosts or their licensors. You may not copy, reproduce, or distribute Site content for commercial purposes without permission.

Disclaimers

The Site and all content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Hostably does not warrant that the Site will be uninterrupted or error-free, or that any property will meet your expectations or be safe, suitable, or available.

Limitation of liability

To the fullest extent permitted by law, Hostably and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the Site or from any stay, booking, act, or omission of a Host or other third party. Any claims about a property or stay should be directed to the Host. Where liability cannot be excluded, it is limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify and hold harmless Hostably from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Site, your violation of these Terms, or your violation of any rights of another person.

Changes to the Site and these Terms

We may change or discontinue any part of the Site at any time, and we may update these Terms from time to time. The “Last updated” date above shows the latest version, and continued use of the Site means you accept the changes.
